पूरे देश में करीब 4 प्रतिशत महिलाएं जेलों में बंद हैं और उनके साथ करीब 1800 बच्चे भी वहीं रहने को मजबूर हैं.
जो अपराध करे,
उसे कानून जेल में भेजे.
अपराध मुक्त समाज को बनाने के लिए सामाजिक और राजनीतिक परिभाषा जेल को अपराध की सजा,
पश्चाताप,
सुधार और बदलाव से जोड़ती है.
जेल में जाने वालों में स्त्री भी हो सकती हैं,
पुरुष भी और यहां तक कि किन्नर भी.
लेकिन उनका क्या जो किसी और के हिस्से के अपराध की सजा पाते हुए जेल में डाल दिए गए.
जिन्हें अपराध का मतलब तक नहीं मालूम जो अ-घोषित अपराधी हैं और जिन्हें जेल भेज देने का पश्चाताप न सरकार को होता है और न ही कानून को या फिर समाज को.
ये वो बच्चे हैं जो किसी परिस्थिति में अपनी मां या पिता के साथ जेल में आए हैं.
इनमें से बहुत से बच्चों का जन्म जेल में हुआ.
हां,
सरकार ने नियम जरूर बना दिए कि जेल में पैदा होने वाले बच्चे के जन्म सर्टिफिकेट पर जेल शब्द नहीं लिखा जाएगा.
भारतीय कानून के मुताबिक ये बच्चे अपने माता या पिता के साथ
6 साल की उम्र तक जेल में रह सकते हैं.
इसके बाद इन्हें या तो किसी एनजीओ को सुपुर्द किया जाएगा या फिर इनका बचा-कुचा परिवार इनको अपने साथ ले जाएगा.
ताज्जुब की बात ये है कि मानवाधिकार की सारी कोशिशों के बावजूद जेल में रहे बच्चों की गिनती कहीं नहीं है.
चूंकि जेल में पड़े बंदी वोट नहीं दे सकते,
ये लोग राजनीति सरोकार की बहस का हिस्सा भी नहीं बन पाते.
बिना किसी जन्मदिवस,
त्यौहार या फिर एक संतुलित परिवार के ये बच्चे हवा में झूलते हैं.
जेल के खुरदरे होते जाते स्टाफ,
पसीने भरी बैरकों और बेहद सीमित साधनों के बीच घुट-घुट कर जीने वाली जेलों में रहते ये बच्चे पैदा होते ही बुजुर्ग हो जाते हैं.
वैसे तो देश में महिलाओं के लिए अलग जेलें बनाने का प्रावधान भी है.
लेकिन महज
17 फीसदी यानी तीन हजार महिलाओं को ही वहां रखने की जगह है.
बाकियों को विभिन्न केंद्रीय जेलों और जिला जेलों में ही अलग बैरकों में रखा जाता है.
ये जेलें भीड़ भरी होती हैं और बच्चों को किसी अलग कमरे में रखने का यहां कोई इंतजाम नहीं होता.
वैसे भारत सरकार ने
1987 में जस्टिस कृष्ण अय्यर समिति का गठन किया था जिसका मकसद जेल की महिला कैदियों की स्थिति का आकलन करना और उसमें सुधार को लेकर अपने सुझाव देना था.
इस समिति ने जेलों में महिला पुलिस की संख्या में बढ़ोतरी पर खास जोर दिया था और जेल में महिला बंदियों की सुरक्षा पर कई जरूरी सुझाव भी दिए थे.
इस समिति ने महिला बंदियों और उनके बच्चों को लेकर भी जरूरी दिशा-निर्देश दिए थे.
लेकिन इसके बावजूद स्थितियां बहुत बदल नहीं सकीं.
राज्य सरकारों की ढिलाई काफी हद तक कायम रही.
अब जबकि सुप्रीम कोर्ट देश की
1382 जेलों की अमानवीय परिस्थति पर तवज्जो दे रहा है,
जेल की महिलाएं और बच्चे फोकस में आ गए हैं.
इस बार महिला एवं बाल विकास मंत्रालय और राष्ट्रीय महिला आयोग को गौरव अग्रवाल के जरिए जो सलाहें भेजी गई,
उनमें मेरी दी बाकी सलाहों के अलावा यह सलाह भी शामिल की गई है कि जेल के बच्चों का जन्मदिन भी मनाया जाए ताकि उनका बचपन और बचपन से जुड़ी यादें सुरक्षित रह सके.
बाहर रहने वाले लोगों को ये अंदाजा भी नहीं है कि जेल में रहने वाले बच्चे इस अलग संसार में जीते हैं. ये खरगोश, गाय और यहां तक कि बकरी को नहीं पहचानते. ये रिश्तों को नहीं पहचानते. रिश्तों के नाम पर इन्होंने अपने आस-पास जेल के बंदी देखे हैं या फिर पुलिस की वर्दी में आने वाले जेल के अधिकारी. ये इस परिवेश से जुड़ी मजबूरियों को ही अपना रिश्ता और नाता समझ लेते हैं. 6 साल के अपने प्रवास में जिंदगी के जो पल ये जेल में गुजारते हैं, वो ताउम्र इनकी यादों से दूर नहीं होती. लेकिन इसकी परवाह किसे है?

Anyone who will know the cause of your initiative will definitely feel the vibe that how much unaware he/she was before. Actually the problem lies with us. We never discuss them publicly,we don't have guts to talk about it. And we blame prisoners that they lack guts,

At such a young age, they don't know the difference between the world inside and the world outside the four walls in which they are living. The conditions under which they are living are also not good. Dr. Vartika Nanda is working tremendously hard to spread the movement for prison reforms in India. She has written three books Tinka Tinka Tihar, Tinka Tinka Madhya Pradesh, Tinka Dasna, and gives a true representation of life inside prisons. In her books, instead of sensationalizing, she sensitizes readers to the harsh realities of prisons. She is shattering the dehumanized and barbaric image of those incarcerated. Through her work, she is showing that inmates are humans with talent, aspirations, and a will to improve themselves. Her newest initiative is opening a prison radio in Haryana, she has earlier done so in Agra. Workshops were held to train inmates and to develop their talents and creativity. Her work is a testament to the idea that rehabilitation and not punishment is the answer.
